These Terms of Sale govern purchases made through The Surest Way Guides, also known asĀ TSWG. They apply to the purchase of digital content, subscriptions, premium access, live sessions, digital products, community memberships, creator services, and any other paid products or services offered through the platform.
By placing an order or making a payment through The Surest Way Guides, you agree to these Terms of Sale.
The Surest Way Guides is a creator monetization and community platform that allows users to purchase access to content, subscriptions, digital products, live experiences, private communities, and related services.
Some products or services may be sold directly by The Surest Way Guides, while others may be sold by individual creators or sellers using the platform.
Unless a product page states that The Surest Way Guides is the direct seller, the relevant creator, mentor, trainer, or vendor listed on the product or offer page is the seller responsible for that specific offer.
These Terms of Sale apply to all paid transactions completed through the platform, including but not limited to:
premium posts, subscription access, digital downloads, guides, templates, blueprints, training materials, private community memberships, paid messaging, commissions, live sessions, booked experiences, and other monetized platform features.
These Terms of Sale should be read together with our Terms of Use, Privacy Policy, Cookies Policy, and any product-specific terms shown at checkout or on the relevant offer page.
We aim to describe all products and services clearly, accurately, and fairly.
Product pages, creator listings, checkout screens, and order confirmations should be read carefully before purchase. They may contain important information about:
the seller, what is included, price, subscription terms, billing cycle, access period, delivery method, technical requirements, eligibility, cancellation conditions, refund position, and any limitations that apply.
Where a creator is the seller, that creator is responsible for making sure the offer description is accurate, lawful, and not misleading.
When you place an order, you are making an offer to buy the product or service described at checkout.
A contract is formed when your order is accepted and payment is successfully processed, or when we send you an order confirmation, provide access, or otherwise make the purchased product or service available.
We may refuse, limit, or cancel an order where reasonably necessary, including in cases of pricing errors, suspected fraud, payment failure, technical issues, breach of platform rules, or where the product or service is no longer available.
All prices displayed on the platform should be presented clearly before purchase. Consumer-law guidance expects pricing and other material terms to be clear and easy to understand, and unfair or hidden wording can be challenged.
Prices may be shown in one or more currencies depending on the product, seller, payment provider, or your location.
Unless otherwise stated, prices do not include taxes, duties, levies, bank fees, currency-conversion charges, or similar charges that may apply in your jurisdiction or through your payment provider.
You are responsible for any such additional amounts unless the checkout page expressly states otherwise.
Payment must be made using a payment method accepted on the platform at the time of purchase.
By submitting payment information, you confirm that:
you are authorized to use the payment method provided, the payment details are accurate, and you authorize the relevant seller and its payment processors to charge the total amount shown at checkout.
We may use third-party payment providers to process transactions securely. Your payment may also be subject to the terms and requirements of those providers.
Many products and services sold through TSWG are digital and may be delivered immediately after payment. This can include downloads, premium content, subscriber access, private communities, streaming access, or other digital services.
If you choose immediate access, download, streaming, or immediate performance, you agree that delivery may begin right away.
Where applicable law gives consumers a cooling-off or cancellation period for online purchases, digital content supplied immediately may be treated differently. UK guidance, for example, says sellers of downloads or streaming services must obtain confirmation that the customer understands they will lose the 14-day cancellation right and must get agreement to immediate supply before the download or stream starts.
To the extent permitted by applicable law, by requesting immediate access to digital content or immediate commencement of a digital service, you expressly request immediate performance and acknowledge that your cancellation rights may be reduced or lost once supply begins.
Some offers on TSWG may be sold on a recurring subscription basis.
Where a subscription applies, the checkout page or offer page should clearly state the billing cycle, renewal frequency, price, and how to cancel. Recent official guidance in both the UK and U.S. emphasizes that recurring terms should be clearly disclosed, consumers should give informed consent, and cancellation should be reasonably straightforward.
By purchasing a subscription, you authorize recurring charges at the intervals disclosed at checkout until you cancel, unless the subscription is for a fixed term that ends automatically.
If your subscription renews automatically, you may cancel future renewals through your account settings or through any other cancellation method made available on the platform.
Cancellation stops future billing only. It does not normally refund charges already validly incurred for the current billing period unless required by law or stated otherwise in a specific offer.
From time to time, we or creators on the platform may offer free trials, promotional pricing, limited-time discounts, bundled offers, or introductory access.
Where a trial or promotional offer converts into a paid subscription, the material terms of that conversion should be disclosed before you are charged. That includes the price, renewal basis, and how to cancel before the paid period begins. Clear disclosure and informed consent for recurring charges are core FTC requirements for online negative-option offers.
Unless the offer says otherwise, promotional offers cannot be combined and may be withdrawn, suspended, or changed lawfully at any time before purchase.
Digital access is usually delivered through the platform itself, by account access, streaming access, download link, email confirmation, creator dashboard delivery, or another digital method identified at checkout.
Unless a different timeline is stated on the relevant product page, digital products and access rights are usually delivered without undue delay after successful payment.
If you do not receive access within a reasonable time, you must contact us or the relevant seller promptly using the contact details provided.
Where a creator, trainer, mentor, or other third-party seller offers a paid item through the platform, that seller is responsible for:
the accuracy of the listing, the legality of the offer, the content delivered, fulfillment of the product or service, any representations made to buyers, and compliance with applicable law.
The Surest Way Guides may provide the platform, payment flow, messaging, dispute support, and account tools, but unless explicitly stated otherwise, TSWG is not the creatorās legal agent, guarantor, or insurer of the creatorās performance.
If a dispute arises between a buyer and a creator-seller, we may review the matter and take platform action where appropriate, but we do not guarantee a particular outcome unless required by law or stated in a separate policy.
Because many products sold on TSWG are digital, accessible immediately, or vulnerable to copying after delivery, refunds are limited once access has been granted, download has begun, content has been streamed, or access credentials have been made available.
Unless otherwise required by law or expressly promised in a product listing, the following are generally not refundable after access begins:
digital downloads, premium posts already unlocked, subscription periods already started, streamed content already accessed, community memberships already activated, and private digital materials already delivered.
However, a refund or replacement may be considered where:
the content was not delivered, the wrong product was delivered, access failed due to a platform or seller error that was not resolved within a reasonable time, the product was materially misdescribed, or a mandatory consumer right applies under the law governing the transaction.
If a purchase relates to a booked session, live event, private consultation, training session, or creator service, the refund position may depend on the circumstances and the product page.
Unless the offer states otherwise:
if the seller cancels and does not reschedule within a reasonable time, the buyer may be entitled to a refund or credit;
if the buyer cancels after the service has begun, after materials have been delivered, or within a stated non-refundable window, a full refund may not be available;
if the buyer misses a live session or fails to attend at the scheduled time, the purchase may be treated as used unless the sellerās terms state otherwise.
Nothing in these Terms of Sale removes or limits any mandatory consumer rights that cannot legally be excluded or restricted.
Where applicable law gives you a right to cancellation, refund, repair, replacement, price reduction, or other remedy, those rights continue to apply even if a clause in these Terms of Sale would otherwise suggest a stricter position.
This section is important because authorities in the UK and EU specifically warn businesses that unfair terms or terms inconsistent with consumer cancellation rights may not be binding.
After a successful purchase, we or the relevant seller may send an order confirmation by email, in-platform notification, or another durable format.
Official UK guidance for online selling says sellers should confirm the contract and provide a copy that the customer can save for future reference.
You are responsible for keeping a copy of your order confirmation, receipt, and any applicable product terms for your records.
If you believe a transaction was made in error, you should contact us first so the issue can be reviewed before initiating a chargeback or payment dispute.
We reserve the right to suspend access to products, services, subscriptions, or accounts while a chargeback or fraud review is ongoing.
Where we reasonably believe that a purchase, refund request, or chargeback is fraudulent, abusive, or unauthorized, we may refuse the transaction, reverse access, suspend services, or take further action permitted by law and platform policy.
Some digital products or live services may require a compatible device, internet access, browser support, software, account registration, or other technical conditions.
It is your responsibility to review any stated technical requirements before purchase.
We are not responsible for failures caused by your device, internet provider, unsupported software, or other buyer-side technical environment unless the issue is caused by us or the relevant seller.
Unless a product page clearly states otherwise, paid products and services are sold for your personal or internal business use only.
You must not copy, resell, redistribute, republish, share login access, exploit, or commercially reuse paid content, downloads, or private materials except where the seller has expressly granted permission.
We or creators on the platform may update, suspend, remove, or discontinue products, services, prices, or features at any time before purchase.
After purchase, any material change to what was sold should not remove rights already validly purchased, except where the change is lawful, necessary, and consistent with the terms of the relevant offer and applicable law.
To the fullest extent permitted by law, TSWG is not liable for indirect, incidental, special, or consequential loss arising from a purchase, including loss of profit, loss of opportunity, loss of audience growth, or loss of expected earnings.
Nothing in these Terms of Sale excludes liability that cannot legally be excluded, including any non-excludable statutory consumer protections.
These Terms of Sale are governed by the laws stated in the platformās legal notice or the applicable law chosen for the transaction, subject always to any mandatory rights or protections that apply in the consumerās jurisdiction.
If a dispute arises, you should first contact us or the relevant seller in good faith so we can try to resolve the issue practically and promptly.
